Court Denies Musk’s Bid to Dismiss OpenAI Harassment Claims

A federal judge has rejected Elon Musk’s attempt to dismiss OpenAI’s claims that he conducted a “years-long harassment campaign” against the AI startup he co-founded in 2015. U.S. District Judge Yvonne Gonzalez Rogers ruled that Musk must face allegations that he sought to harm OpenAI through press statements, social media posts, legal claims, and a “sham bid” for the company’s assets.

Musk originally sued OpenAI and CEO Sam Altman over the company’s shift to a for-profit model, claiming it strayed from its mission of developing AI for humanity’s benefit. OpenAI countersued in April, alleging fraudulent business practices under California law. The judge found the countersuit legally sufficient to proceed. A jury trial is scheduled for spring 2026.

Musk Threatens Legal Action Against Apple Over App Store Rankings

Elon Musk announced on Monday that his AI startup xAI will pursue legal action against Apple, accusing the tech giant of violating antitrust rules by allegedly favoring OpenAI’s ChatGPT in App Store rankings.

Musk claimed Apple’s App Store policies make it “impossible for any AI company besides OpenAI to reach #1,” calling the practice a “clear antitrust violation.” At present, ChatGPT is ranked first in the U.S. App Store’s “Top Free Apps,” while xAI’s chatbot Grok stands in fifth place.

Musk also criticized Apple for not featuring X (formerly Twitter) or Grok in its “Must Have” section, despite X being the “#1 news app globally” and Grok ranking among the top five apps. He suggested Apple might be “playing politics” in its selection process.

Apple, OpenAI, and xAI did not respond to Reuters’ requests for comment. However, OpenAI CEO Sam Altman pushed back against Musk’s claims, pointing out the irony by referencing Musk’s own alleged efforts to manipulate X for personal advantage.

Community fact-checkers on X highlighted that other AI apps, such as China’s DeepSeek and Perplexity AI, have reached the top spot in the App Store this year, undermining Musk’s argument that only OpenAI benefits from Apple’s system.

The dispute comes amid increasing regulatory scrutiny of Apple’s App Store dominance. Earlier in 2024, the EU fined Apple €500 million ($581 million) for anti-competitive practices, ruling that the company’s restrictions prevented app developers from directing users outside the App Store ecosystem.

Musk’s challenge may add further pressure to global regulators already investigating Apple’s control over app distribution and its partnerships with AI companies.

OpenAI set to launch AI-powered browser to rival Google Chrome

OpenAI is reportedly preparing to release a new AI-powered web browser in the coming weeks that aims to challenge Google Chrome’s dominance, according to sources familiar with the matter. The browser will leverage artificial intelligence to transform the way users interact with the web, potentially offering a more integrated experience that keeps some browsing activities within a ChatGPT-style chat interface rather than directing users to external websites.

This move marks a strategic push by OpenAI to gain direct access to user data—an essential asset for competing with Google, whose Chrome browser is a critical component of Alphabet’s advertising business, generating nearly 75% of its revenue. By controlling browsing data, OpenAI could directly rival Google in targeted advertising and user engagement.

With over 500 million weekly active ChatGPT users, OpenAI’s browser has the potential to significantly disrupt Google’s advertising ecosystem. The browser will be built on Chromium, the open-source codebase behind Chrome and other browsers like Microsoft Edge and Opera, allowing OpenAI to control data collection and integration more effectively.

The new browser is also designed to integrate OpenAI’s AI agent tools, such as Operator, enabling automated actions on behalf of users, including booking reservations or filling forms within websites—enhancing convenience and utility.

OpenAI’s founder Sam Altman, who has driven the company’s rapid innovation since ChatGPT’s launch in 2022, is betting on this browser as part of a broader strategy to embed AI deeper into daily personal and work life.

Competition is fierce: Google Chrome currently commands over two-thirds of the global browser market with more than 3 billion users, while Apple’s Safari holds a distant second place with 16%. Other AI-driven browsers like Comet by Perplexity, The Browser Company, and Brave have already launched AI-enhanced browsing experiences.

The Department of Justice’s ongoing antitrust actions against Google—following a ruling that Alphabet holds a monopoly in online search—highlight the regulatory challenges facing the search and browser giant. OpenAI has even expressed interest in acquiring Chrome if forced divestiture occurs.

Unlike merely creating a plug-in for existing browsers, OpenAI’s decision to build its own browser aims to maximize control over user data, a crucial factor for AI’s effectiveness and business value.

OpenAI declined to comment on the launch details.
