Nintendo and The Pokémon Company File Lawsuit Against Pocketpair, Demand Injunction and JPY 5 Million in Damages Over Palworld

Pocketpair, the developer behind the survival game Palworld, has provided further details about the ongoing patent infringement lawsuit filed by Nintendo and The Pokémon Company in September. In a statement released on Friday, Pocketpair clarified the specific demands made by the plaintiffs. Nintendo and The Pokémon Company are seeking an injunction to prevent Palworld from being released or distributed, citing the game’s alleged similarities to Pokémon, particularly with regard to the design of its monsters. The companies are also pursuing compensation, requesting damages exceeding JPY 5 million (approximately Rs. 27.7 lakh) from Pocketpair.

According to the lawsuit, Nintendo and The Pokémon Company claim that Palworld infringes upon three patents they hold. These patents are said to cover elements of the game that bear resemblance to the well-known Pokémon franchise, which could lead to confusion among players. Pocketpair responded to the legal action by outlining the specifics of the accusations in a post on their official website, emphasizing that they intend to defend their position in the ongoing litigation.

The legal battle centers around the release of Palworld, which launched on January 19, 2024. The game has drawn attention due to its unique blend of gameplay elements, including survival mechanics and monster collection. However, Nintendo and The Pokémon Company argue that the creatures featured in Palworld are too similar to their iconic Pokémon designs. In the lawsuit, the plaintiffs seek not only an injunction to stop the distribution of the game but also financial compensation for any damages incurred due to the alleged patent infringements.

In response to these claims, Pocketpair expressed its intention to resolve the matter legally, indicating that it will vigorously defend itself against the lawsuit. The developer has yet to comment on the specific patents cited by the plaintiffs, and the outcome of the case will likely have significant implications for the future of Palworld and similar games in the genre. As the case progresses, both companies will likely continue to argue the merits of their respective positions in court.
